Definitions in liability  

The following definitions are used within the legislation and are essential for the determination of liability

Owner

means a person who has a material interest (leasehold) in the property and there is no one resident who has an inferior interest. (Subject to an overall material interest being greater than 6 months)

Resident

means any person over the age of 18 years and has his sole or main residence in the dwelling.

Secure tenant

means a tenant under a secure tenancy under Part IV of the Housing Act 1985.( Landlord is a LA HA or similar & premises is tenants main home)

Statutory tenant

means a tenant within the meaning of the Rent Act 1977 or Rent (Agricultural) Act 1976.

Freehold

means the fee simple absolute in possession of the property - the right to exercise rights over the property in perpetuity

Licensee

means a person who has a right to occupy the premises but not an exclusive right to occupy

Leasehold

means a person has the rights over a property for a fixed term of years
