Charging Orders

Reg 50 & 51 CT (A & E) Regs 1992

A £1000 minimum must be outstanding and Liability Order (s)  must be held

An application made to County Court to include debt plus costs incurred in obtaining liability order

The debtor must have legal interest in the dwelling and the Court must consider the debtor's circumstances

Changes to Charging Orders for 2004/05 

From April in both England & Wales a billing authority will be able to aggregate two or more liability orders made against the same person to meet the £1000 threshold for making an application for a charging order.
