The Role of the Justices

Types of Justices 

Lay magistrates

These are from all backgrounds, they receive training and advice

They may consist of LA members / Professionals / early retired / self employed

LA members must declare an interest if the Court is hearing cases presented by their own Authority

 Stipendiary magistrates

This is a trained / professional magistrate who will conduct the court themselves. They are legally qualified.

Where a stipendiary magistrate is present there will be no need for a Justices Clerk

The responsibility of all Magistrates 

The responsibility of all magistrates is to:

  1.  To hear all evidence presented

  2. To hear all defences

  3. To decide on the case presented before them

  4. Beyond all reasonable doubt

  5. Decide and act as any 'reasonable' Court would act
